Summary: Existing law requires the director of the Department of Motor Vehicles to establish a program that permits the renewal of identification cards by mail or through the department's Internet Web site. This bill would require the department, no less than 60 days prior to the expiration date of a person's identification card, to provide the person with a written notice of the expiration date.

AB 462 - (Lowenthal, Bonnie) Air pollution districts: fees: school buses. (C-09/06/2011

 Summary: Existing law authorizes specified air pollution control and air quality management districts to adopt a fee applicable to motor vehicles registered in counties within that district, and requires the fee to be collected by the Department of Motor Vehicles. Existing law, until January 1, 2015, authorizes the amount of the fee to be up to $6. Existing law requires the revenues from the first $4 of the fee to be used for specified purposes. Existing law requires that the revenues from the last $2 of the fee be used for specified programs that the district determines remediate air pollution harms created by motor vehicles, including purchases of new school buses pursuant to the State Air Resources Board's Lower-Emission School Bus Program. This bill would additionally authorize a district based on that determination to use the last $2 of the fee for programs to replace onboard natural gas tanks on school buses owned by a school district that are 14 years or older, with a funding amount not to exceed $20,000 per bus and to enhance deteriorating natural gas fueling dispensers of fueling infrastructure operated by a school district, with a one-time funding amount not to exceed $500 per dispenser, pursuant to the Lower-Emission School Bus Program. This bill contains other related provisions.

Summary: Existing law establishes a motor vehicle inspection and maintenance (smog-check) program, administered by the Department of Consumer Affairs and the State Air Resources Board, which provides for the inspection of all motor vehicles, except those specifically exempted from the program, upon registration, biennially upon renewal of registration, upon transfer of ownership, and in certain other circumstances. Existing law requires the Department of Motor Vehicles to require, upon initial registration, and upon transfer of ownership and registration, of a motor vehicle, and upon registration of a motor vehicle previously registered outside this state that is subject to those provisions, a valid certificate of compliance or a certificate of noncompliance, as appropriate, with respect to smog certification. Existing law specifies that a certificate of compliance or noncompliance is valid for 90 days, except as provided. This bill would extend the period during which a certificate of compliance or noncompliance is valid to 180 days.

Summary: Existing law requires the State Energy Resources Conservation and Development Commission (commission) and the State Air Resources Board (board) , in consultation with other state and local agencies the commission deems necessary, to develop and adopt recommendations for the Governor and Legislature on a California Strategy to Reduce Petroleum Dependence. Existing law also requires the commission, in partnership with the board, to develop and adopt a state plan to increase the use of alternative transportation fuels. This bill would require the commission and the board to, among other things, adopt policies and regulations to attain the fuel consumption targets set forth in state plan to increase the use of alternative transportation fuels, coordinate the attainment of the targets with provisions regulating alternative fuels, and assess how future guidelines, regulations, and investments affect the attainment of the fuel consumption targets. The bill would require the commission and the board, on or before January 1, 2013, in consultation with other state and local agencies the commission and the board deem necessary, to update a specified economic analysis, develop a strategy for petroleum fuel use reduction and alternative fuel use in specified vehicles, and identify regulatory and statutory barriers to attaining the petroleum fuel consumption targets. The bill would require the commission and the board, commencing January 1, 2014, and triennially thereafter until January 1, 2024, to report to the Legislature on progress in reaching the fuel consumption targets.

Summary: Existing law requires the amount appropriated by the Legislature for the use of the Department of Motor Vehicles and the Franchise Tax Board for the enforcement of the Vehicle License Fee Law to be calculated as specified and transferred from the Motor Vehicle License Fee Account in the Transportation Tax Fund to the Motor Vehicle Account in the State Transportation Fund. This bill would allocate to the Department of Motor Vehicles (DMV), from the amount calculated under this provision, $25,000,000 for the 2011-12 fiscal year and would deem that amount as the cost to the DMV for the collection of the motor vehicle license fee. The bill would increase the amount allocated to the DMV for subsequent fiscal years by the growth rate in the California Consumer Price Index, as specified. The bill would require the Department of Finance to report to the Legislature if the amount allocated in a fiscal year is insufficient to cover the costs incurred by the DMV and to propose budget changes to address the funding shortfall. The bill would instead require that the balance of the amount calculated under these provisions that is not allocated for the support of the DMV or to the Franchise Tax Board be deposited into Local Revenue Fund 2011. This bill contains other related provisions and other existing laws.

Summary: Existing law requires the California Alternative Energy and Advanced Transportation Financing Authority to establish a Property Assessed Clean Energy (PACE) Reserve program to assist local jurisdictions in financing the installation of distributed generation renewable energy sources or energy or water efficiency improvements meeting specified requirements that are permanently affixed on real property through the use of a voluntary contractual assessment. Existing law, until January 1, 2015, appropriates up to $50,000,000 from the Renewable Resource Trust Fund to the authority for the purposes of the PACE Reserve program and authorizes the authority to expend up to $300,000 of that appropriation for initial administrative costs in implementing the PACE Reserve program. This bill would additionally require the authority to administer a Clean Energy Upgrade Program that would be developed by the State Energy Resources Conservation and Development Commission and the authority to reduce the costs to property owners of a loan provided by a financial institution that has a loan program that satisfies the specified requirements. Because this bill would authorize the use of the money appropriated for the PACE Reserve program for the Clean Energy Upgrade Program, this bill would make an appropriation. The bill would require the authority to report annually specified information regarding the program. The bill would increase the amount of the appropriation that may be expended for initial administrative costs to $550,000, thereby making an appropriation. This bill contains other related provisions and other existing laws.

Summary: Existing law requires the amount appropriated by the Legislature for the use of the Department of Motor Vehicles (DMV) and the Franchise Tax Board (FTB) for the enforcement of the Vehicle License Fee Law to be calculated as specified and transferred from the Motor Vehicle License Fee Account in the Transportation Tax Fund to the Motor Vehicle Account in the State Transportation Fund. This bill would instead require the Legislature to determine and appropriate annually an amount for the use of the DMV and the FTB for the enforcement of the Vehicle License Fee Law. The bill would deem, for the 2011-12 fiscal year, $25,000,000 as the cost to the DMV for the collection of the motor vehicle license fee. This bill contains other related provisions and other existing laws.

Summary: Existing law establishes a motor vehicle inspection and maintenance (smog check) program, developed, implemented, and administered by the Department of Consumer Affairs. The smog check program provides for the inspection of a motor vehicle, among other circumstances, upon its initial registration, upon transfer of ownership, and for vehicles registered in certain areas of the state, biennially upon renewal of registration. A violation of smog check requirements is a crime. Existing law requires the smog test to include a

-visual or functional check of emission control devices specified by the department. This bill, notwithstanding this provision, would prohibit a smog check technician from conducting an under-the-hood visual inspection as part of a smog check inspection. Because a violation of this prohibition would be a crime, the bill would impose a state-mandated local program. This bill contains other related provisions and other existing laws.

SB 901 - Steinberg Air pollution: vehicle retirement program. (I-02/18/2011 html pdf)

Summary: Existing law creates the High Polluter Repair or Removal Account in the Vehicle Inspection and Repair Fund, and makes moneys deposited in the account available, upon appropriation by the Legislature, to the Department of Consumer Affairs and the State Air Resources Board to establish and implement a program for the repair or replacement of high polluters. Existing law also creates a program for the voluntary retirement of motor vehicles that are high polluting vehicles, administered by the Bureau of Automotive Repair pursuant to guidelines adopted by the state board, to be funded from the Enhanced Fleet Modernization Subaccount in the High Polluter Removal and Repair Account. This bill would make this program available only to the highest polluting vehicles, with priority given to those highest polluting vehicles registered in air basins that are out of attainment with federal air quality standards. The bill would make other technical changes.
